THIS SWEEPSTAKES IS OFFERED IN NY, NJ, CT, PA, DE, RI AND MD ONLY. THIS SWEEPSTAKES IS VOID ELSEWHERE AND WHEREVER PROHIBITED BY LAW.   THIS SWEEPSTAKES SHALL BE CONSTRUED AND EVALUATED IN ACCORDANCE WITH ALL APPLICABLE LAWS AND REGULATIONS.  THIS SWEEPSTAKES IS OPEN SOLELY TO PERSONS WHO ARE LEGAL RESIDENTS OF, AND CURRENTLY RESIDING IN, ONE OF THE ELIGIBLE STATES LISTED ABOVE, AND WHO ARE AT LEAST 18 YEARS OF AGE WITH AN ACTIVE AND VALID E-MAIL ADDRESS AT TIME OF ENTRY.

NO PURCHASE NECESSARY TO ENTER OR WIN.   A PURCHASE WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING A PRIZE.  INTERNET ACCESS IS REQUIRED TO ENTER.

United States Army (“Sponsor”) is offering this Sweepstakes (“Sweepstakes”).  David Kessler & Associates, Inc. (“Administrator”) is administering the operation of, and prize fulfillment under, this Sweepstakes.  Sponsor and Administrator shall be referred to collectively as the “Sweepstakes Entities”.  

1. This Sweepstakes is open solely to legal residents of NY, NJ, CT, PA, DE, RI and MD (the “eligible states”), who (a) are presently located and living in one of the eligible states, (b) are 18 years of age or older as of the time of entry, and (c) have an active and valid e-mail address as of time of entry.  The Sweepstakes is void outside the eligible states and wherever prohibited by law. Employees, officers, and directors of the United States Army (the “Sponsor”), the MLB Entities* (as defined below) and each of their respective parent companies, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and the members of the immediate families (defined for these purposes as including spouse, biological, adoptive or step-parents, children, siblings, grandparents, grandchildren and their respective spouses, regardless of where they reside) or households (whether or not related) of each of the foregoing, are not eligible to participate or win a prize.  *The “MLB Entities” shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLBAM” or “MLB.com”), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, The MLB Network, LLC, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of each of the above entities. Proof of eligibility may be required. The Sweepstakes is subject to all applicable federal, state and local laws, rules and regulations. 
   
   
2. Sweepstakes begins at 12:00:01 pm Eastern Time (“ET”) on 8/5/10 and ends at 11:59:59 pm ET on 9/25/10 (the “Sweepstakes Period”).  Limit of one (1) entry per person/household (as determined by email address account holder and/or household address).  Proof of entry submission will not be deemed proof of receipt of such entry by Sponsor or Administrator.

3. How to Enter: Complete an on-line entry form at http://www. goarmyextras.com/cbsentry (the Web site”) with all required information and submit it in accordance with the instructions on the Web site and herein. All entries must be received by11:59:59 pm ET on 8/5/10. Any Sweepstakes entrant who desires to be contacted for future promotional purposes may check the opt-in box on the entry form.  All information submitted online by entrants is subject to, and will be treated in a manner consistent with, Sponsor’s privacy policy located at http://www.goarmy.com/privacy/index.jsp) and MLB.com’s Terms of Use accessible at http://mlb.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp and Privacy Policy accessible at www.mlb.com/privacy.  All Sweepstakes entry forms shall become the exclusive property of Sponsor and shall be neither acknowledged nor returned except as provided herein.
   
   
4. In the event of a dispute as to who is entitled to receive a Sweepstakes entry, such entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided that such person otherwise meets each of the eligibility requirements of these Rules.  "Authorized account holder" means the natural person who was assigned an e-mail address by an Internet access provider, service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  Any potential prize winner hereunder may be requested to provide proof that he/she is the authorized account holder. Sweepstakes Entities hereby specifically reserve the right to invalidate any and all Sweepstakes entries that are made through any robotic, automatic, mechanical, programmed or similar entry duplication method, or through fraud, and to disqualify the individuals using such a method from participating in this Sweepstakes or receiving any prize hereunder.  By entering, each participant in this Sweepstakes hereby agrees to irrevocably release, indemnify and hold harmless the Sweepstakes Entities, each of their respective advertising, marketing and promotion agencies, and the  officers, directors, employees, designees and agents of each of the foregoing (collectively, the “Released Parties”), from and against any and all claims, actions, causes of action, demands, judgments, liability, injuries, damages, losses, costs and expenses (collectively, “Claims”) arising out of or relating to, directly or indirectly, in whole or in part, any of the following:  (a) participation of entrant in this Sweepstakes or in any Sweepstakes-related or prize-related activities (if applicable); (b) the acceptance, possession or use/misuse of any prize (if applicable) by entrant; (c) electronic transmissions or Sweepstakes entries that are lost, late, stolen, incomplete, illegible, indecipherable, inaccurate, damaged, garbled, destroyed, misdirected or not received by Sponsor or Administrator for any reason; (d) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of any Sweepstakes entries, or the destruction of or unauthorized access to, or alteration of, any Sweepstakes entries; (e) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that may jeopardize the administration, security, fairness, integrity, safety or proper conduct of this Sweepstakes; (f) the submission of any Sweepstakes entries in a manner that is not expressly allowed under these Rules; (g) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in this Sweepstakes; (h) any typographical or other error in any printing or advertising related to this Sweepstakes, in  the administration or execution of this Sweepstakes, or in the announcement of prizes/prize winners; or (i) cheating or fraud by any participant. SOME JURISDICTIONS, MAY NOT ALLOW SOME OF THE LIMITATIONS OR EXCLUSIONS OF LIABILITY LISTED ABOVE, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR PROHIBITIONS REGARDING SUCH LIMITATIONS AND EXCLUSIONS. All incomplete or otherwise non-conforming Sweepstakes entries will be disqualified from the Sweepstakes and ineligible to receive any prize hereunder.  If, for any reason beyond Sponsor’s control, this Sweepstakes cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause(s) that may corrupt or affect the security, administration, fairness, integrity, safety or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor hereby specifically reserves the right, exercisable at any time thereafter by Sponsor in its sole discretion or by Administrator, on behalf of Sponsor, to terminate, suspend or modify this Sweepstakes.  If this Sweepstakes is terminated before the scheduled conclusion date of the Sweepstakes Period as stated herein, then the Administrator (or its designee) will select the potential winners of the prizes described below by means of a random drawing from among all eligible, non-suspect Sweepstakes entries received as of the date and time of such termination.  Sweepstakes Entities hereby reserve the right, exercisable at any time in their sole discretion (and without limitation of any and all other legal and/or equitable rights and remedies that may be available), to disqualify from this Sweepstakes and to prosecute any individual(s) who is (are) found to be tampering with or attempting to tamper with the Sweepstakes entry process or any other part of this Sweepstakes.  CAUTION: ANY ATTEMPT BY ANY PERSON(S) DELIBERATELY TO DAMAGE ANY WEB SITE OR OTHERWISE TO CORRUPT THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR HEREBY SPECIFICALLY RESERVES THE RIGHT TO DISQUALIFY (FROM THIS SWEEPSTAKES), PROSECUTE AND SEEK DAMAGES FROM AND AGAINST ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
   
   
5. One (1) Grand Prize will be awarded, consisting of an autographed Steiner Derek Jeter Baseball. Approximate Retail Value (“ARV”): $515.  No prize transfers, assignments, redemptions for cash or substitutions of any kind will be allowed, except as provided herein. Sponsor may substitute a prize (or any component thereof) with a different prize (or prize component) of equal or greater value, if the advertised prize (or any component thereof) becomes unavailable. All applicable income taxes in connection with the prizes awarded in this Sweepstakes are the sole and full responsibility of the prize winners. All other details of any prize that are not set forth specifically above shall be determined at Sponsor's sole discretion. The prizes will be awarded only to the authorized account holders of the email accounts associated with the selected entries in the prize drawing. Odds of winning a prize depend on the number of eligible entries received. 
   
   
6. Administrator is independent of Sponsor, and each of Administrator's decisions in all matters relating to eligibility, prize fulfillment and all other aspects of this Sweepstakes shall be final, binding and non-appealable in all respects. Each potential prize winner in this Sweepstakes must comply fully with all provisions of these Official Rules in order to be eligible to receive his/her prize. Administrator will attempt to notify each potential prize winner of his/her selection by phone, postal mail, and/or email at the email address supplied at the time of entry within approximately five (5) days after the date of the above-described drawing. If: (a) a potential prize winner is found to be ineligible for any reason; or (b) a potential prize winner fails to respond to any prize notification from Administrator within five (5) days; or (c) a potential prize winner fails to comply with all provisions of these Official Rules; or (d) the notification to a potential prize winner is returned as undeliverable; or (e) a potential prize winner cannot accept his/her prize in accordance with these Rules, then; (i) the potential prize winner will forfeit all rights to receive the prize; (ii) Sweepstakes Entities shall be relieved of any and all further obligations or liability to the potential prize winner; and (iii) Sweepstakes Entities shall have the right (but not the obligation) to select an alternate potential prize winner by means of a subsequent random drawing conducted by Administrator (or its designee) from among the remaining  entries. The potential prize winners shall be required to complete, sign and return an Affidavit of Eligibility, Liability Release, and (where legal) a Publicity Release, within seven (7) days after the date of initial notification of the potential prize winners’ selection. If a potential prize winner fails to comply with this condition, then (a) the potential prize winner will forfeit all rights to receive the prize; (b) Sweepstakes Entities shall be relieved of any and all further obligations or liability to the potential prize winner; and (c) Sweepstakes Entities shall have the right (but not the obligation) to select an alternate potential prize winner by means of a subsequent random drawing conducted by Administrator (or its designee) from among the remaining entries.
   
   
7. By participating, each entrant in this Sweepstakes agrees that Sponsor, Administrator, MLB Entities, and their respective promotion/advertising agencies, and each of their respective parent companies, affiliates and subsidiaries, and the officers, directors, partners, principals, partnerships, employees and agents of each of the foregoing, shall have no liability whatsoever for, and shall be held harmless from and against, any injuries, losses or damages of any kind to persons or property, including without limitation death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of the prize or any component thereof (if applicable), or participation in this Sweepstakes or participation in any Sweepstakes-related or prize-related activities, and further acknowledge that said parties, to the extent allowed by law, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. By entering, entrants: (1) waive (to the extent allowed by law)  all rights to claim punitive, incidental, consequential or any other damages, other than actual out-of-pocket expenses; (2) agree that the Sweepstakes will be governed by the laws of the State of New York, without regard to conflicts of laws principles, and all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action and shall be brought in a court of competent jurisdiction in the State of New York applying New York law; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees.
   
   
8. Subject solely to Sponsor’s privacy policy at http://www.goarmy.com/privacy/index.jsp, any potential prize winner  hereby irrevocably agrees that upon his acceptance, receipt or use of the prize, the Sweepstakes Entities may use his/her name, city and state of residence, likeness (photographic or simulated) and/or voice for any and all advertising, marketing, promotion, public relations or other business operations or trade purposes whatsoever, in any and all media (whether now known or hereafter devised) throughout the world, in perpetuity, without any restriction(s), further notice, approval, or further payment or compensation of any kind or amount. By participating in this Sweepstakes, each entrant irrevocably agrees to be bound by (i) each provision of these Official Rules and (ii) each decision of the Administrator, which shall be final, binding and non-appealable in all respects.    
   
   
9. For the names of the Grand Prize Winner (available after 10/2/10), send a self-addressed, stamped  #10 size envelope, postmarked by no later than 10/2/10, to GoArmy for Teamwork CBS Sweepstakes, P. O. Box 6185, Buffalo Grove, IL 60089-6185.
